Aery Aviation, LLC announced today that the Federal Aviation Administration has withdrawn in its entirety the civil penalty letter issued to the company on December 22, 2025. The proposed civil penalty totaled approximately $15.7 million. No portion of that proposed civil penalty will be assessed in this matter; there has been no finding of violation and the matter is closed.
In its formal notice, the FAA stated: “After full consideration of the above-referenced case and the evidence presented, we have determined that it is not in the interest of justice to pursue this particular matter. The civil penalty letter issued December 22, 2025, is therefore, hereby withdrawn.”
Aery contested the proposed action from the beginning and maintained throughout the administrative process that it did nothing wrong and that the proposed penalty was not supported by the facts and law applicable to the operations at issue. Aery presented documentary evidence through the FAA’s administrative process addressing the factual, aircraft, operational, and jurisdictional issues raised in the proposed action.
“The result is clear: the proposed $15.7 million civil penalty has been withdrawn in full, there has been no finding of violation, and no civil penalty will be assessed in this matter,” said Scott Beale, President of Aery Aviation. “From the beginning, Aery maintained that it did nothing wrong. We stood behind our people, our operations, and the evidence we presented. We appreciate the FAA’s consideration of the case and evidence, and we respect the agency’s important aviation-safety mission.”
Beale continued: “The public announcement of a proposed penalty of this magnitude caused significant reputational and commercial harm to Aery before the matter was resolved. Today, our responsibility is to make the outcome equally clear to our employees, customers, government partners, lenders, insurers, suppliers, and the aviation community. We are proud of our team for remaining focused on safe, compliant operations and on serving our customers throughout this process.”
Aery’s safety and compliance programs, FAA certificates, quality systems, and customer obligations remain central to the company’s operations. Aery will continue to focus on its defense, government, medical, engineering, maintenance, modification, and commercial aviation businesses.
